What to do if arrested (or about to be) for DWI in Texas

I'm often asked what people should do if they are about to be arrested for DWI in Texas.  My usual answer in this situation is easy: DO NOTHING! SAY NOTHING!

1. REFUSE ALL TESTS. -No eye test, balance test, counting, ABCs, breath, blood. REFUSE ALL TESTS WITHOUT A WARRANT.

2. ANSWER NO QUESTIONS EXCEPT WHO YOU ARE. Give them your ID and insurance. Then STFU.

SAY: "I DO NOT ANSWER POLICE QUESTIONS WITHOUT A LAWYER."

The police will still arrest you if they believe you are intoxicated, but you will be well-positioned to fight your case if you aren't falling-down throwing-up drunk.
